TERMS AND CONDITIONS

NICTUS ONLINE SHOPPING

1. Definitions

  • Website: The official Nictus online store at www.nictus.com.na.

  • Online Shoppers: Customers purchasing goods through the Nictus online store.

  • Nictus / We / Us / Our: Nictus (Pty) Ltd.

  • Third-Party Provider: Any company partnered with Nictus to sell products via the online store.

  • You: The customer making purchases through the Nictus online store.

2. General

These terms govern your use of the Nictus website for purchasing goods and should be read alongside:

  • The Website Terms of Use,

  • Credit Terms (if applicable), and

  • The Delivery and Returns Policy.

By shopping online with Nictus, you agree to comply with all these terms.

3. Acceptance

By placing an order, you accept these terms and conditions and consent to receiving invoices electronically.

4. Online Profile & Personal Information

To shop online, you must create a Nictus profile with a username and password. You are responsible for maintaining the confidentiality of your login details. Nictus is not liable for any loss resulting from unauthorized access.

By using the online store, you consent to the collection and use of your personal information for order fulfillment, payment processing, and communications. If you do not agree, please do not use the online shopping service. See the Nictus Privacy Policy for more details.

5. Products & Pricing

5.1 Product Availability

  • All products are subject to availability and priced according to the Windhoek branch; additional transport fees may apply for other branches.

  • Delivery is limited to Namibia.

  • If a product becomes unavailable after ordering, we will notify you promptly.

5.2 Pricing

  • Prices are in Namibian Dollars (NAD) and applicable only in Namibia.

  • Prices may change without prior notice.

5.3 Product Display

  • Product images and colors are for illustrative purposes only and may vary based on your device.

5.4 Order Confirmation

  • Orders are only confirmed once Nictus processes and dispatches the items or makes them available for collection.

  • Adding items to your cart or wish list does not reserve stock or pricing.

5.5 Order Cancellation by Nictus

Nictus may cancel orders in cases of:

  • Suspected fraud,

  • Pricing or stock errors, or

  • Customer history of non-payment or abuse of promotions.

Canceled orders will be fully refunded.

6. Delivery, Collection & Storage

6.1 Delivery Fees

  • Fees depend on location and product type.

  • Furniture and large appliances may incur additional costs.

6.2 Delivery Times

  • Deliveries are Monday to Friday, 09:00 – 17:00 (excluding public holidays).

  • Only available within Namibia via third-party couriers.

6.3 Delivery Process

  • Delivery is made to the address provided at checkout.

  • Nictus is not responsible for items after delivery is signed for.

6.4 Order Collection

  • Orders can be collected from selected stores or distribution centers.

  • Collection must be arranged at least 2 working days in advance.

  • Valid ID and order confirmation are required.

6.5 Storage Policy

  • Furniture cannot be stored.

  • A storage fee of N$100 per item per day applies.

  • Orders uncollected after 28 days may be canceled, with deductions applied to any refund.

7. Returns & Warranty

7.1 Returns Policy

  • Unused goods may be returned within 7 days of delivery/collection.

  • Items must be in original packaging with proof of purchase.

  • Some products (e.g., mattresses, beds) are non-returnable.

7.2 Incorrect or Defective Items

  • Do not remove labels or packaging.

  • Contact Nictus immediately for a free return and replacement or refund.

  • Returns are not accepted for damage caused by misuse, improper installation, or exposure to harsh conditions.

7.3 Warranty

  • Goods are covered by the manufacturer’s warranty where applicable.

  • Furniture and appliances are for residential use only.

  • Natural variations in leather, wood, or fabric are not considered defects.

8. Order Cancellation by Customer

  • Orders can be canceled before dispatch via your order summary.

  • If items have left the warehouse, a delivery fee and 10% cancellation fee will apply.

  • Refunds are processed once returned items are received.

9. Payment & Security

Nictus uses secure payment service providers to protect online transactions.

9.1 Payment Methods

  • Credit/Debit Card: Processed at checkout.

  • Nictus Credit Accounts: Purchases can be made using an existing credit facility.

  • EFT/Bank Transfer: Payment must be received before processing.

9.2 Refunds

  • Refunds for returns or canceled orders may take up to 10 working days to appear in your account.

10. General Terms

  • Nictus may update these terms without prior notice.

  • By using the online store, you agree to comply with the latest terms.
